Land Disturbance Permit Information

Any construction activity involving clearing, grading or excavation over one (1) acre requires a Rutherford County Land Disturbance Permit. The permit is issued for 18 months and can be extended if needed. Below is a permit fee breakdown for the Land Disturbance Permit.

Agricultural Use

If the Rutherford County Planning and Engineering staff determine that the activity falls under an Agricultural Use, then there is no permit fee. A permit will be issued at no fee. For the conditions of Agricultural Use please see Section 4  of the Rutherford County Stormwater Ordinance.

Preliminary Plats

Permit fees are determined by acreage. A charge of $150 for the permit plus $100 per acre of the property being developed will be assessed. Acreage is rounded down to the nearest acre.

Site Plans

Permit fees are determined by acreage. A charge of $150 for the permit plus $100 per acre of the property being disturbed will be assessed. Acreage is rounded down to the nearest acre

Minor Plats

The cost of the permit is $150 per lot that does not have an existing house located on it.

Acreage Tracts

Permit fees are determined by the amount of land being disturbed. A permit fee of $150 allows for disturbance of up to 1.99 acres. For any disturbance over two acres, a fee of $100 per additional acre is added to the permit fee. Acreage is rounded down to the nearest acre.

Please note the State requires permitting through Tennessee Department of Environmental and Conservation (TDEC) if more than one (1) acre is disturbed. See link below for TDEC permits.
