Zoning Compliance Form

Administrative Review Applications and Checklists

Land Disturbance Application - Any construction activity involving clearing, grading or excavation over one (1) acre requires a Rutherford County Land Disturbance Permit. For more information and fee schedule click link on the left. For new home construction, please fill out the additional Erosion Prevention and Sediment Control (EPSC) Plan form.

Fence Design Guidelines Affidavit We do not permit fences but require a Fence Design Guideline Affidavit for all fences. Please complete the form, have it notarized and email it to [email protected] or bring it into our office. If you do not have access to a Notary, we can notarize it for you in our office.

Engineering Fees Application This application is for Construction Plan Review Fees, Land Disturbance/Grading for Subdivision Fees, Land Disturbance/Grading for Commercial Fees, Critical Lot Grading Plan Fees, As-Built Records/Lot Release Review Fees, Construction Inspection Fees.

Minor Home Based Business Application This application is for home based businesses that meet the qualifications for a minor home based business. This type of business is allowed by right in residential areas. Please consult with a staff planner to determine if your business will qualify.

Accessory Dwelling Unit (ADU) Application This application is for the establishment of a second residence on a parcel pursuant to certain conditions.

Letter of Attorney-in-Fact This form should be submitted along with any rezoning, variance or conditional use application where the applicant is not the current landowner.

Sign Permit Application This application must be completed and approved prior to the installation of signs in the unincorporated limits of Rutherford County.

Rutherford County Bicycle Ride Information Sheet Any person or group who desires to conduct a ride containing at least 30 people is requested to complete this form.

Board of Zoning Appeals Applications

Special Exception Application This application form is primarily for major home based businesses, seasonal and temporary uses, and accessory dwelling units.

Variance Application This application form is for any request for a variance from the rules and regulations specified in the Rutherford County Zoning Ordinance.

Administrative Appeals This application form is used to appeal any order, requirement, decision or determination by any department or office responsible for administration of the Rutherford County Zoning Ordinance.

Sign Variance Application This application form is for any request for a variance from the rules and regulations specified in the Rutherford County Zoning Ordinance pertaining to signage.

Planning Commission Applications and Checklists

Rezoning Application This is an application to change the zoning designation of a parcel(s).

Development Application (Subdivision and Site Plan) This new application form is used for all subdivision plats and subdivision plats submitted to Rutherford County for review. All applications for building permits, except one-and two- family dwellings and residential accessory structures are required to obtain site plan approval prior to making application for building permit.

Site Plan Review Checklist

Preliminary Plan Checklist This checklist provides information on the required elements of a preliminary plan. This checklist needs to be submitted along with any Preliminary Plan Application.

Final Plat Checklist This checklist provides information on the required elements of a final plat. This checklist needs to be submitted along with any Final Plat Application.

Bond/Plat Extension Request This is an application to request Planning Commission approval for an extension of a bond or plat.

Subdivision Waiver (Variance) Request This application form is for any request for a variance from the rules and regulations specified in the Rutherford County Subdivision Regulations.
